Can a car insurance company refuse to pay a claim if someone else was driving the vehicle?

My son who is 28 was driving my car he got into an accident, it was his fault the insurance company is saying that because we live in the same household and he was not on the policy that i misrepresented the policy so they may not pay the claim. Is this legal or should I get a attorney
